Court Sets Hearing on EchoStar’s TiVo Appeal
U.S. Court of Appeals Sets Oral Arguments for Oct. 4

A federal appellate court has set oral arguments for Oct. 4 on EchoStar Communication’s appeal of a patent-infringement verdict that TiVo won against it.
In April 2006, a Texas jury found that some of EchoStar’s digital video recorders had infringed on a patent held by TiVo, and the satellite providers has set aside $94 million to cover that judgment and interest.
EshoStar is appealing that verdict, and now the U.S. Court of Appeals for the Federal Circuit has scheduled oral argument in early October on the satellite provider’s appeal of the district court judgment.
“We had requested prompt oral argument and are pleased that the United States Court of Appeals for the Federal Circuit has scheduled the oral argument in EchoStar's appeal of the district court judgment of patent infringement for early October 2007,” TiVo said in a prepared statement Tuesday. “This action brings us one step closer to resolution of EchoStar's appeal and implementation of the district court's injunction, which has been stayed pending the appeal.”
