Gol TV, Dish Tangle in Court Over License Fees

DBS Dropped Bilingual Soccer Channel in August

By Linda Moss -- Multichannel News, 12/5/2008 7:17:00 AM

Gol TV and Dish Network have been sparring in court over license fees that the bilingual soccer channel claims it is entitled to receive.

There was a filing in U.S. District Court in Colorado Monday regarding the lawsuit that Gol TV filed back in October against the satellite provider.

Dish Network dropped Gol TV Aug. 1 when its carriage agreement with the sports channel expired.

In its suit, the programmer claims that Dish Network owes it unspecified license fees for April, May, June and Gol TV has the U.S. rights to La Liga and FC Barcelona's Leo MessiJuly. In an answer filed Nov. 28, the satellite provider said it made a payment Nov. 17 to Gol TV, and asks that it be awarded attorney’s fees and costs.

According to a scheduling order filed Monday this week, Dish Network’s Nov. 17 payment “provided Gol with what Gol contends is a partial payment of the amount that was then owing to Gol, and that Gol remains entitled to additional payment for the final period of the parties’ agreement.”

That orders says that Dish Network denies it owes Gol TV any additional money for the “final period,” which was July 22 to 31. The satellite provider also denies that the dollar amount remaining in controversy following its November payment exceeds $75,000.

Both parties have had informal settlement talks, according to legal papers.
