FCC Gains New Court Date

For the second time in a week, a panel of the U.S. Court of Appeals for the Third Circuit in Philadelphia has changed the oral-argument date in the case challenging the Federal Communications Commission's new broadcast-ownership rules.

On Thursday, the court scheduled oral arguments for Feb. 11, acting on an extension request from the FCC. The court originally set arguments for Nov. 5 but changed it to Jan. 12 last week.

"This will probably be the final tweak," said Andrew Schwartzman, president of Media Access Project, a public-interest law firm representing Prometheus Radio Project in challenging the FCC rules as too favorable to large media conglomerates.

The Third Circuit has barred the FCC from enforcing the new rules while the case is pending in court.
