Class Status Nixed In Cable-Modem Suit

LOS ANGELES-A federal judge here denied class-action status to two cable-modem subscribers who had filed an antitrust suit alleging some of the country's biggest operators have illegally tied high-speed Internet access in with content.
The decision, which can be appealed, eliminated the risk of the cable operators having to pay billions of dollars in damages, Washington lawyer Burt Braverman, who is defending Adelphia Communications Corp. in the case, said last week. "If it's sustained [on appeal], I think it's the death knell for the litigation."
