The Score is Tied in the XM / Sirius Merger
July 23, 2008

Well it has all come down to this, the game is tied 2 to 2, with only one more vote to go.  Except this is not a game this is the decision on the merger of XM Satellite Radio and Sirius Satellite Radio.

The ball is now entirely in the court of Deborah Taylor Tate who with one decision will make or break these two companies.

Earlier today FCC Commissioner Jonathan Adelstein pulled his support for the merger voting no.  He was quoted that he did not want to support “a monopoly with window dressing.”

When this merger was first announced 491 days ago I personally thought that this merger would cause a monopoly, but time have changed since the deal was announced, satellite radio is now fighting for it’s life.  With the advent of using your cell phone to listen to basically any radio station anywhere and in some cases even watch any television station on your cell phone the satellite radio technology might soon go the way of the 8 track tape.

Satellite Radio needs this merger to survive.  Both companies are operating at a huge loss and have never earned a profit.  They need to be combined as one to continue to operate, and with their combined resources can offer their customers the best content anywhere.

What I have found the funniest about this entire merger was the NAB going around opposing the merger, yet they kept on saying that satellite radio was not competition to broadcasters.  If this was the case the NAB wouldn’t have been lobbying so hard to get the FCC to deny the merger.

If commissioner Tate were to give the merger a thumbs down it would not surprise me to see one if not both of the satellite radio companies fold within the next 2 year.

I personally hope the merger is approved, but if it is I am not looking forward to seeing what kind of changes will need to be made as other companies and associations have asked the FCC to take 25% of the spectrum back from XM/SIRIUS if the merger was approved.  While I can see the need to give up some spectrum, 25% of the spectrum would make the merger not worth it.

So now we sit and wait.  The tension in the air is so great that you can almost cut it with a knife.  One thing is for sure, when all is said and done this entire ordeal would make an excellent made for television movie.

Now as I wait for the decision to come down, I will sit and listen to some music from AOL Radio on my iPhone.  Yes Virginia there is competition to Satellite Radio.

THEY NEED TO APPROVER THIS MERGER SINCE THEY DO COMPETE WITH REGULAR RADIO AND OTHER DEVICES

Scott, I respectfully disagree. Satellite radio put themselves in a hole when they signed multi-million dollar deals with celebrity radio broadcasters. This merger is nothing more than a bail-out of bad business practices. If they fail, and there is a market, someone else will step in and fill that demand.

The problem with HD radio (at least in Maine where I live) is that they only play the same CRAPPY rotation as the normal FM station. It seems that these PD's still haven't learned that not all the listeners want to hear the same song at the same time every day. That is what is so great about the Sirius/XM Merger. I currently have Sirius but with the merger I'll have even more of a spectrum of choices. Although I wouldn't be surprised if the merger got voted down, I'm really pulling for it. I can't stand terrestrial radio anymore!!!

If it means saving Opie and Anthony's show, I am in favor of the merger not going through. I just have this feeling now from what I have read and heard that the newly formed company will get rid of a lot of the channels and axe O &

I just have this feeling now from what I have read and heard that the newly formed company will get rid of a lot of the channels and axe O and A. I don't want Howard. If they merge and get rid of the stuff I listen to, I'll cancel. I am not alone. That is not good for business. On the other hand, if they don't merge, Sirius will probably go under because they cannot pay Howard. They need to stop the bleeding $$. XM would be more likely to survive on its own.

Your're right on about the NAB Scott, why lobby so hard if they aren't a competitor? The FCC is a joke, they could care less about the consumer.

listen, there's a reason sat radio is in the predicament it's in. and they did it to themselves. so we should set the prevailing law aside and bail them out? NOT ON YOUR LIFE. kill the merger and let them sink or swim on their own merits. if not, then the FCC is a worthless regulatory organization (oh wait, it is already!) and should be forced to stick with engineering and technical issues only.

Time to stop the b.s. We've seen the FCC compromise itself on newspaper and television stations ownership in the same markets. Only reason for opposition is the monopoly terrestrial radio has established…and wants to keep. And I've had enough of them. Push it through…or consider this just another example of corruption.
