Red Hot Chili Peppers Sue Showtime Over Right To Use "Californication"

In a suit filed yesterday in LA, the Red Hot Chili Peppers are seeking a permanent injuction barring Showtime’s use of the title "Californication."
"Californication" is the name of RHCP’s 1999 album and title song.
The lawsuit alleges unfair competition, dilution of the value of the name and unjust enrichment, claiming the title is "inherently distinctive, famous … and immediately associated in the mind of the consumer" with the Red Hot Chili Peppers.
The suit also seeks damages and restitution from profits derived from the show.
