Appeal Goes Gemstar-TV Guide’s Way

The U.S. Federal Circuit Court of Appeals backed Gemstar-TV Guide International Inc. in its appeal against the International Trade Commission, the company said Thursday.

The court ruled that the ITC “incorrectly dismissed certain of the company's infringement claims based on narrow interpretation of the patents in suit,” Gemstar-TV Guide said in a prepared statement.

“The court's decision reaffirms the company's belief in the strength of its patent portfolio,” the company added.

The ruling was in response to ICT investigation No. 337-TA-454, covering set-tops and components.

The court revised the legal construction of certain claims in two patents and returned the case to the ITC so that body can determine whether Scientific-Atlanta Inc. infringed on Gemstar-TV Guide’s patents in light of the court's revised legal claim construction.

S-A said in a prepared statement that it continues to believe that it did not infringe on any claim of any valid and enforceable Gemstar-TV Guide patent.
