Ga. Late-Fee Challenge Rejected

The Georgia Supreme Court refused Wednesday to hear a late-fee challenge by
customers of the former Scripps-Howard Cable.

Attorneys for the consumers tried to overturn an appeals-court decision that
ruled that cable subscribers are subjected to late fees because they voluntarily
pay bills past the due date. Therefore, consumers of former Scripps-Howard
systems in the state wouldn't get refunds for the $5 late fees they
challenged.

The consumers, who are now served by Comcast Corp., won their case at the
state court in Fulton County last year but lost on appeal.

Comcast has two late-fee suits pending of its own. Terry Bienstock, an
attorney for the MSO, said the ruling in the Scripps-Howard case would benefit
Comcast in those other actions.
