Abernathy: Cable-Merger Ruling Soon

Federal Communications Commission member Kathleen Abernathy said Monday that
she was hoping the agency will act on the AT&T Broadband-Comcast Corp.
merger this week.

'I would hope that it could come out this week,' she said a press conference
in her FCC office.

She declined to reveal whether she supports placing in the public record AOL
Time Warner Inc.'s high-speed-data-carriage agreement with AT&T Comcast.

'The basic issue is whether or not it is relevant to the scope of our merger
review, and that's what we are dealing with,' she added.

EarthLink Inc. and various consumer groups want to review the agreement,
claiming that AT&T Comcast's power in the broadband-access market is
relevant to the FCC merger review.

Fearing commercial harm, Comcast has asked the FCC not to yield to disclosure
demands.
