ACTV Files Appeal in Disney Dispute

Interactive-TV player ACTV Inc. filed an appeal to its patent-infringement
dispute with The Walt Disney Co. before the U.S. Court of Appeals, Federal
Circuit Wednesday.

ACTV -- which is about to be acquired by Liberty Media Corp.'s new
interactive-TV venture -- filed a lawsuit against Disney and certain of its
subsidiaries last year in U.S. District Court for New York's Southern District,
claiming that Disney infringed upon three of its patents. But the court ruled in
favor of Disney and dismissed the case under a summary judgment.

ACTV chairman and CEO David Reese said in a prepared statement that the
appeal was 'both a necessary and appropriate course of action' to protect its
intellectual property.

Disney did not comment on the appeal's filing by press
time.
