Court Backs FCC Telecom-Pole Rate


A three-judge federal court has upheld the Federal Communications Commission's decision to slash Georgia Power Co.'s annual pole-attachment rate for telecommunications carriers from $53.35 to between $6.56-$8.24.

Although the case dealt with pole attachments by telecommunications carriers and not cable companies, the decision would protect cable companies from price-gouging to the extent that they need pole space to offer traditional phone services.

The decision was handed down by Judges Susan H. Black and Stanley Marcus from the 11th Circuit U.S. Court of Appeals and U.S. Judge Donald Middlebrooks from the Southern District of Florida.
