Lawyers for Adelphia Communications Corp. founder and former CEO John Rigas
and his son, former executive vice president of operations Michael Rigas, argued
in court that the duo should by tried separately from Rigas' other son, former
executive VP and chief financial officer Tim Rigas, and former director of
internal reporting Michael Mulcahey, Reuters reported.
John and Michael Rigas told a federal judge it would be unfair to try them
with the two other defendants because they are not charged specifically in all
counts of the lengthy indictment.
U.S. District Judge Leonard Sand said he would issue a ruling on the motion
at a later date.
Adelphia filed for bankruptcy in June after defaulting on $7 billion in bank
loans. The company is suing the Rigases for racketeering, breach of contract and
abuse of control.
