No Mass Access in Mass.


The Massachusetts Supreme Judicial Court rejected an effort by the state's
Department of Telecommunications and Energy to ease building access for all
telecommunications firms.

The dispute began in 2000, when the DTE revised state policy to allow new
telecommunications firms and cable operators access to commercial and
residential wires, conduits and other infrastructure.

The Greater Boston Real Estate Board sued in November 2000, arguing that the
state policy is an unlawful taking of property.
