OpenTV Settles Disney Suit

OpenTV Corp. said The Walt Disney Co. agreed to license some of its intellectual property as part of a court settlement it reached with the company and its ESPN and ABC subsidiaries.

OpenTV’s ACTV Inc. unit sued Disney, ABC and ESPN in December 2000, alleging that the enhanced-TV technology the companies used to add interactive elements to shows such as Who Wants to Be a Millionaire and Monday Night Football on ABC and ESPN’s Sunday Night Football infringed ACTV patents.

OpenTV said it granted Disney a license to use the patents named in the lawsuit as part of the settlement, and Walt Disney Internet Group entered into negotiations for a “nonexclusive, multiyear development agreement with OpenTV for the creation and marketing of enhanced-television programming.”
