The Texas Third District Court of Appeals has upheld a state law guaranteeing
building access to all telecommunications providers.
The legislature passed the law in 1995 to facilitate the transition of the
industry from fully regulated to competitive. But the policy was challenged as
unconstitutional by the Texas Building Owners and Managers Association.
In its June 5 ruling, the court held that the statute was written to balance
the rights of tenants to access their choice of providers with the rights of
property owners to be compensated.
